Terms of sale

These are the terms and conditions on which we agree to supply products ordered on our website www.justoverthetop.co.uk. Please read these terms carefully before you submit your order to us.

We may change these terms and conditions from time to time. You should check the terms regularly.

Please see our Privacy Policy for details of how we process your personal data.

  1. Contact

Who we are. We are JOTT-JUST OVER THE TOP-UK Limited (“JOTT”), a company registered in England and Wales with company number 14057677. Our registered office address is 7th & 8th Floors 24 King William Street, London, EC4R 9AT. Our registered VAT number is 424309321.

If we have to contact you we will do so by telephone, email or (if necessary) by post, using the contact details you provided to us.

2.Your order

2.1 How to place an order. Please follow the instructions on the website to place your order. Before the order is processed, a summary will be provided showing the products selected and the order details, including the order total, VAT and any delivery costs. You must confirm the products to be ordered by following the instructions on the order pages, and making payment.

2.2 How we will accept your order. We will send an automatic email listing the products ordered. This will show the total including VAT and delivery costs, and, if necessary, any issues related to the order (for example, product unavailability). Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.

2.3 If we cannot accept your order. We reserve the right to refuse any order for legitimate reasons, or example, if we have identified an error in the price or description of the product(s), or if the quantity of products ordered is abnormally high. If we are unable to accept your order, we will inform you of this and will not charge you for the product(s).

Products on offer are available while stocks last. Product availability information is provided when ordering. If a product ordered is unavailable, we may choose to offer you a product of similar quality and price, or provide you with a refund within 30 (thirty) days of the date the order is placed.

2.4 International customers. We are not able to deliver orders to customers based outside of the UK. Customers based outside of the UK should visit our EU website at www.jott.com.

2.5 Products may vary slightly from their pictures. The photos of the products on our website are for illustrative purposes only. Please note that colours on our website may vary slightly depending on how your monitor is calibrated and which operating system your computer or mobile device uses. We advise customers to refer to the description of each product to be sure of their specific characteristics. 3.Price and payment

3.1 Paying for your order. The price of the order (which includes UK VAT where applicable) will be in pounds sterling and will be indicated during the order process. We will provide you with an invoice in an email order confirmation.

3.2 Delivery costs. The price of the order does not include delivery costs. Please see the ‘Delivery’ section below for further details of delivery costs.

3.3 Payment method. We accept payment for orders by Visa, MasterCard and PayPal.

3.4 What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced on the website. If the correct price at your order date is higher than the price stated, we will contact you and offer you the option to either confirm your order at the correct price or cancel your order. If the correct price at your order date is lower than the price stated, we will refund you the difference.

4.Delivery

4.1 Delivery method. We will deliver your order in accordance with the delivery option you selected when placing your order. Deliveries are made by DPD standard or another independent carrier. The products ordered may be delivered together in one delivery or in separate deliveries.

4.2 Deliveries in the United Kingdom will be made to the address stated in your order. The carrier will require a signature on delivery. Deliveries will be made during working hours, Monday to Saturday, excluding public holidays.

4.3 Delivery costs. Our standard delivery costs are set out below, although the cost of the delivery will depend on the delivery option chosen by you, and will be shown in the order details prior to you confirming your order.

      • Standard delivery: £10
      • Orders over £135 are exempt from delivery fees.

4.4 Delivery times. Packages are generally shipped within 1-2 working days after we receive payment from you. Orders placed on after 12pm on a Friday, or on a Saturday or Sunday, will be dispatched the following Monday or Tuesday (excluding public holidays). During peak periods (sales, holiday periods, etc.), the time it takes to prepare and ship your order may be slightly longer.

4.5 When you become responsible for the product. The product will be your responsibility from the time it is delivered at the address specified in the order process. Please check the products received against your order.

4.6 When you own products. You own a product once we have received payment in full.

4.7 We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

5.Returns policy

We do not offer exchanges, only refunds.

5.1 Returns. If you are not satisfied with your purchase you can return your products for a full refund, provided we get them back within 30 days and in perfect original sale-able condition. Only unworn, unstained, undamaged, unwashed items returned with the tags attached and original bag/pouch/cover intact will be accepted.

5.2 How to make a return. You must follow these instructions to make a return:

(a) click on the returns link provided in the email confirmation, or this link: https://jott-uk-prod.myshopify.com/a/return  and follow the steps;

(b) select the item(s) you wish to return and indicate the quantity and the associated reason for return; and

(c) submit the returns request.

5.3 Once you have submitted your returns request, you will receive an email attaching a return form. Please print this form and attach it to the package. If you do not receive this email please check your spam/junk folder, and if it is not there, please contact us at https://contact.gorgias.help/forms/g0jmpppy.

The postal address for returns is JOTT, 103 Marylebone High Street, London W1U 4RP. This will be shown on the returns form.

Alternatively, you may return your order in person at our Marylebone store (address above).

Returns shipping. You are responsible for any return shipping charges (with the exception of returns of faulty items or items that are described or priced incorrectly). The returns form will include pre-paid postage label. Once we have processed your return, we will deduct £5 from the amount to be refunded to you, to reflect the returns shipping charges.

For your protection, please be sure to obtain a receipt for your returns parcel. We are not responsible for any loss or theft of the package during transit.

5.4 How we will refund you. We will refund you the price you paid for the products to the same payment method you used at the time of purchase (PayPal, or Visa or MasterCard).

We may make deductions from the price to reflect delivery costs. See ‘Returns shipping’ above for further information.

We may also make a deduction from the price to reflect any reduction in the value of the products, if this has been caused by your handling them in a way which means they are not in perfect original sale-able condition in the original packaging and with all tags attached. If we refund you the price paid before we are able to inspect the products and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.

5.5 When we will refund you. We will make any refunds due to you within 14 days after the day on which we receive the product back from you, or if earlier, 14 days after the day on which you provide us with evidence that you have sent the product back to us.

5.6 Customs. Where the return is being made from a country outside of the UK, you must mention that it is a return of goods on the customs declaration. If any customs duties apply, these shall be payable by you.

6.If there is something wrong with your product

6.1 If you think there is something wrong with the product(s) ordered please contact us: https://contact.gorgias.help/forms/g0jmpppyWe honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law.

6.2 We will either provide you with a refund, or repair or replace the faulty product(s). If we provide you with a refund, the refund will be made as soon as possible within 14 days of the date on which we acknowledged the defect. We will refund you the price you paid for the products to the same payment method you used at the time of purchase.

6.3 We shall not be liable for normal wear and tear to products.

7.Your additional statutory right to cancel the contract

If you are a customer in the UK, EU or in Norway, Liechtenstein or Iceland, you have a statutory right to cancel any order you place with us within 14 days of receiving your order. This is an additional and separate right to our returns policy (set out above). You may choose either method to return orders.

For customers from any other country, this cancellation right is not available to you. Please use our returns policy (set out above).

7.1 Cancelling your order before delivery. You may cancel your order before it is delivered by emailing us at https://contact.gorgias.help/forms/g0jmpppy or by completing a cancellation form and sending it to us via email or post.

7.2 Cancelling your order after delivery. If your order has already been delivered, you have a legal right to change your mind within 14 days after the day on which the products come into your possession and receive a refund. The following terms apply to this cancellation right:

(a) How to cancel. To cancel, you must inform us within 14 calendar days of the day on which you receive the product. You can contact us via email at https://contact.gorgias.help/forms/g0jmpppy or by completing a cancellation form and sending it to us via email or by post.

Returning the cancelled order. You must return the product to us in perfect original sale-able condition in the original packaging and with all tags attached without undue delay and within 14 calendar days of telling us you wish to cancel, by post to: JOTT Marylebone, 103 Marylebone High Street, London W1U 4RP. You are responsible for any return shipping charges. For your protection, please be sure to return your products via recorded or registered post.

(b) How we will refund you. We will refund you the price you paid for the products, and will arrange a refund of any delivery costs (with the exception of additional costs arising from the fact that the customer has chosen, where applicable, a delivery method other than the cheapest standard delivery method offered by us), by the method you used for payment. However, we may make deductions from the price (excluding delivery costs) to reflect any reduction in the value of the products, if this has been caused by your handling them in a way which means they are not in perfect original sale-able condition in the original packaging and with all tags attached. If we refund you the price paid before we are able to inspect the products and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.

(c) When we will refund you. We will make any refunds due to you as soon as possible, and within 14 days after the day on which we receive the product(s) back from you or, if earlier, 14 days after the day on which you provide us with evidence that you have sent the product back to us.

(d) Partial return. If you return only part of your order, we will process a refund for the returned products only. The delivery costs will be refunded as follows:

(I) if the delivery costs have been calculated according to the number of products ordered, they will be refunded in proportion to the products you returned; or

(II) in the case of flat-rate delivery costs, they will not be refunded.

If any products not included in the return were acquired free of charge at the date of the order, as part of a sale or promotional offer, we will request the return of the free item. Similarly, if any products not included in the return were acquired at a discounted price due to being bundled with other items (for example, a promotion where you buy one item and get a second item at a lower price), we will request the return of the discounted item.

If you do not return the free or discounted item, we will deduct from your refund (as applicable):

    1. a sum equal to the value of the free item. This will be calculated in accordance with the price shown on our website at the date of the order; or
    2. a sum equal to the relevant discount. This will be calculated as the difference between the price paid and the price shown on our website at the date of the order.

8.Our rights to end the contract

8.1 We may end the contract if you break it. We may end the contract for a product at any time by writing to you if:

(a) you do not make any payment to us when it is due and you still do not make payment within 14 days of us reminding you that payment is due; or

(b) you do not, within a reasonable time, allow us to deliver the products to you.

8.2 You must compensate us if you break the contract. If we end the contract in the situations set out in paragraph 8.1 we will refund any money you have paid in advance for products we have not provided but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.

9.Our responsibility for loss or damage suffered by you

9.1 Your legal rights. You have certain rights under the law, including that any products you order through this website will be of satisfactory quality, fit for their intended purpose, and will conform to your order and any description given on this website. Nothing in these terms and conditions will affect your legal rights.

9.2 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

9.3 We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, loss of goodwill, business interruption or loss of business opportunity (and in each of these cases whether the losses suffered are direct or indirect). This is subject to paragraph 9.4 below.

9.4 Loss and damage that is not limited by us. Nothing in these terms and conditions will have the effect of limiting or excluding our liability (i) for death or personal injury caused by our negligence, or (ii) fraudulent misrepresentation, or (iii) any other liability which cannot be excluded or limited under applicable law, such as your legal rights referred to in paragraph 9.1 above.

10.Other important terms

10.1 You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

10.2 Nobody else has any rights under these terms and conditions. This contract is between you and us. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.

10.3 If a court or relevant authority finds part of these terms are unenforceable, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

10.4 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

11.2 These terms and conditions are governed by English law and are subject to the exclusive jurisdiction of the courts of England and Wales, except for consumer users resident in Northern Ireland or Scotland who may bring proceedings in their respective countries
